Big Update for Law Students Regarding Legal Services Examination! Know Details

The Supreme Court today gave a big verdict regarding who studying law. On Tuesday, the Supreme Court gave an important decision on the appointment of lower court judges, i.e. Junior Division Civil Judges. The court said that to appear for the examination for these posts, a candidate must have at least three years of legal practice. This means that one can take the Legal Services Examination only after graduating in law and working as a lawyer for three years.

The bench comprising Chief Justice of the Supreme Court B.R. Gavai, Justices K. Vinod Chandran and A.G. Mashi said in its verdict, ‘It is observed that many problems have arisen due to the new law graduates appointed to the judiciary.’ In such a situation, candidates for the post of Civil Judge Junior Division can no longer be appointed by qualifying the examination directly. They will have to practice as an advocate for at least three years.

Experience is Essential for Court Work

This decision of the Supreme Court will have a far-reaching impact on the judicial system of the country. The jury, in its decision, said that it is very important to gain court experience before joining the judicial system. The CJI said that ‘many High Courts of the country have experience that the appointment of young law graduates to judicial posts is creating many problems.’ Practical experience of court work is very important to maintain the efficiency and competitiveness of the judicial system.The Supreme Court has given this decision on the petition of the ‘All India Judges Association’.

Certificate Must be Shown

The Supreme Court also said that the period of practice of a candidate can be considered from the date of enrollment in law school. The court clarified that this order will not apply to previous appointments in the High Court and this condition will apply only to future appointments. To fulfill this condition, the candidate will have to submit a certificate issued by a senior advocate or a designated judicial officer who has practiced for 10 years. If a lawyer is practicing in the Supreme Court or High Court, he/she will have to submit a certificate issued by an advocate or a designated judicial officer who has practiced in the Supreme Court for 10 years.
